1. Agreement to Terms

These Terms of Service constitute a legally binding agreement between you (“User”, “you”, or “your”) and Okay Done Ltd., a company registered in Ireland (“Company”, “we”, “us”, or “our”), concerning your access to and use of the Workapp mobile application, the website located at workapp.chat, and any related services, features, or content (collectively, the “Services”).

By accessing or using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must discontinue use of the Services immediately.

We may update these Terms from time to time. Updates will be indicated by revising the “Last Updated” date. Continued use of the Services after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

The Services are intended for users aged 16 years or older.

If you are under 18 years old, you may only use the Services with the consent of a parent or legal guardian.

By using the Services, you represent that you meet these eligibility requirements.

3. About Workapp

Workapp provides a platform that enables users to communicate, collaborate, and exchange information.

Workapp does not act as an employer, recruiter, broker, or intermediary in any employment or business relationships between users.

Any arrangements, agreements, or communications between users are solely between those users, and the Company is not responsible for them.

4. User Accounts

Certain features of the Services require the creation of a user account.

You agree to:

  • provide accurate and current information
    • keep your login credentials secure
    • promptly update information if it becomes inaccurate.

You are responsible for all activity that occurs under your account.

You must notify us immediately if you become aware of any unauthorized use of your account.

5. Inviting Other Users

Workapp may allow users to invite other individuals to join the platform by providing their name or email address.

By sending an invitation, you confirm that:

  • you have permission to share that person’s contact information
    • the invitation is sent for legitimate personal or professional purposes
    • you will not use the invitation feature to send spam or unsolicited marketing messages.

We may limit or disable invitation features if they are misused.

6. Acceptable Use and User Conduct

You agree to use the Services in a lawful and respectful manner.

You must not:

  • harass, threaten, intimidate, or abuse other users

  • use the Services to promote or solicit illegal activities, scams, or fraudulent opportunities

  • send spam, bulk invitations, or unsolicited promotional messages

  • impersonate another person, business, or organization

  • share confidential or personal data without authorization

  • upload or transmit viruses, malware, or other malicious code

  • interfere with or disrupt the operation of the Services

  • attempt to gain unauthorized access to accounts, systems, or networks

  • use automated bots, scripts, or scraping tools to access the Services

  • engage in fraudulent, deceptive, or otherwise unlawful activities through the Services.

Violation of these rules may result in suspension or termination of your account.

7. Automated Access and Data Extraction

You may not access or use the Services through automated means without our prior written permission.

This includes bots, crawlers, scraping tools, or automated systems designed to collect user data, extract platform content, or replicate the functionality of the Services.

8. Misuse of the Services

You agree not to use the Services in any manner that could harm the platform, its users, or the Company, even if such use is not specifically described in these Terms.

We reserve the right to determine, in our sole discretion, whether any use of the Services constitutes misuse or violates the spirit of these Terms.

We may suspend or terminate access to the Services where we reasonably believe that a user’s behaviour is harmful, abusive, or inconsistent with the intended purpose of the platform.

9. User Content

Users may submit content including messages, files, or other materials (“User Content”).

You retain ownership of your User Content.

However, by submitting content through the Services you grant Okay Done Ltd. a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, and display that content solely for the purpose of operating and improving the Services.

You are responsible for ensuring that your content does not violate applicable laws or the rights of others.

10. Messages and Conversation Content

Workapp allows users to exchange messages, files, and other content as part of conversations.

Content shared within conversations may be visible to other participants.

The Company does not claim ownership of user messages but retains the rights necessary to host and process such content in order to operate the Services.

Messages and shared content may remain visible to other participants even if you delete your account.

11. Copyright and Intellectual Property Complaints

We respect the intellectual property rights of others.

If you believe content available through the Services infringes your intellectual property rights, please contact [email protected] with details of the alleged infringement.

We may investigate complaints and remove or restrict access to content where appropriate.

12. User Data and Storage

Users are responsible for maintaining their own copies and backups of any content, files, or information uploaded to the Services.

Workapp does not guarantee that user content will be stored indefinitely or recoverable in the event of technical failure.

The Services are not intended to function as a primary file storage or backup service.

To the fullest extent permitted by law, Okay Done Ltd. shall not be responsible for the loss, corruption, deletion, or failure to store user data or content.

13. User Interactions and Disputes

Users are solely responsible for their interactions with other users of the Services.

The Company does not verify the identity, qualifications, or reliability of users.

We are not responsible for disputes, claims, or damages arising from interactions between users.

14. Moderation and Content Removal

We reserve the right, but are not obligated, to monitor activity on the platform.

We may remove content, restrict functionality, or suspend accounts that violate these Terms or applicable laws.

15. Changes to the Services

We may modify, suspend, or discontinue the Services or any features at any time.

We are not obligated to maintain any specific functionality or feature.

16. Third-Party Services

The Services may contain links to third-party websites or services.

We are not responsible for the content, policies, or practices of third-party services.

17. Privacy

Your use of the Services is also governed by our Privacy Policy.

We process personal data in accordance with the General Data Protection Regulation (GDPR) and applicable Irish data protection laws.

18. Disclaimer

The Services are provided on an “as is” and “as available” basis.

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied.

We do not guarantee that the Services will be uninterrupted, secure, or error-free.

19. Limitation of Liability

To the maximum extent permitted by law, Okay Done Ltd. will not be liable for indirect, incidental, or consequential damages arising from the use of the Services.

Our total liability for any claim will not exceed €100 or the amount paid by you to us in the previous 12 months, whichever is greater.

20. Indemnification

You agree to indemnify and hold harmless Okay Done Ltd. from claims arising from:

  • your use of the Services
    • your User Content
    • violations of these Terms
    • violations of applicable law.

21. Legal Requests and Disclosure

We may disclose user information where required by law or where reasonably necessary to:

  • comply with legal obligations
    • enforce these Terms
    • investigate fraud or misuse
    • protect users, the Company, or the public.

22. Transfer of Ownership

If the Company undergoes a merger, acquisition, or sale of assets, user accounts and associated data may be transferred to the new owner.

23. Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including technical failures, internet outages, or natural disasters.

24. Governing Law

These Terms are governed by the laws of Ireland.

Any disputes will be subject to the exclusive jurisdiction of the Irish courts.
